Obtaining a residence permit with the right to self-employment (Cuenta Propia) is possible both for residents of Spain and for foreigners who are only planning to move to the country. In the first case, you must be in Spain with legal status and have a residence or stay permit valid for more than 1 year. In the second case, the application is submitted through the Spanish consulate in your country of citizenship or current residence. The duration for which your Cuenta Propia residence permit will be approved depends on what type of residence you currently hold. Let's examine each option in detail.
Initial Cuenta Propia residence for 1 year
Initial residence is issued in the following cases:
when applying for this residence permit for the first time through the Spanish consulate in your country of citizenship or current residence
when modifying from a student visa (higher and professional education) after successful completion of studies
when modifying from a student visa (language courses) after completion of studies, subject to the following conditions:
you submitted an application for initial receipt/renewal of the visa under the old regulations before May 20, 2025
you have a DELE or SIELE Spanish language proficiency certificate (the level must correspond to that stated in your studies)
when modifying from a residence permit without the right to work (no lucrativa) after 1 year of residence in Spain (the permit comes into effect after mandatory registration of the applicant with Seguridad Social)
when modifying from a residence permit for job search (búsqueda de empleo) after 1 year of residence in Spain (important condition: the business project proyecto empresarial must correspond to the level/profile of completed studies in Spain)
Long-term cuenta propia residence for 4 years
Such a permit is obtained by applicants when modifying from a residence permit with the right to work (digital nomad, highly qualified specialist, startups, etc.) after 1 year of residence in Spain.
